Contract terms
As of: 13 October 2026 · Version digital-2026-10-13-v2. For new training applications from adults and contracting parties with parental responsibility. Existing contracts retain the terms agreed when they were concluded.
English translation of the German original. Application and contract documents are issued in German.
1. Provider and training services
The provider is Anh Son Le, trading as Shinzen Dojo Berlin, sole trader, Neheimer Str. 2, 13507 Berlin. Contact: info@shinzen-dojo.de; telephone 030 88691569. This training contract does not establish membership of Shinzen Dojo Berlin e.V.
The dojo offers guided Kyokushin karate training with traditional values and suitable supplementary training methods. The booking covers the training group shown in the contract overview, at the location specified there and at the regular training times stated before submission of the application. There is no entitlement to a particular instructor. Additional services are included only if expressly identified as contractual services.
2. Contracting party and participation
For an adult contract, the adult applicant is both the contracting party and the participant. For a child or youth contract, the named person with parental responsibility enters into the contract in their own name for the named child's training and owes the fees. The child is the participant, not the contracting party responsible for payment.
The person with parental responsibility confirms that they have the necessary authority to register the child. The right to train is personal and cannot be transferred to another person. The contract with the person with parental responsibility does not end solely because the child reaches adulthood; changing the contracting party requires a separate agreement.
3. Application and acceptance
Before submission, the training services, contract start date, initial term, monthly fee, joining fee, minimum total price and these contractual terms, including the withdrawal information, are displayed and made available to save. By submitting the application using the control clearly marked as creating an obligation to pay, the applicant makes a contractual offer.
The immediate acknowledgement of receipt and application copy document receipt only; they do not constitute acceptance or a request for payment. The dojo may accept the offer within seven calendar days. If no acceptance occurs within that period, the applicant is no longer bound by the offer.
The contract is formed only when the acceptance email, initiated following the dojo's personal review, reaches the applicant. A further handwritten signature by the dojo is not required. The email contains the final contract PDF with the agreed details and the specific version of the contractual terms. Changes to the application require a new offer and its acceptance; an amended PDF alone is insufficient.
4. Start date, term and cancellation
The requested contract start date is specified in the application before submission and confirmed unchanged on acceptance. If that date has already passed or is to be changed, a new application agreed with the applicant is required; the date will not be moved unilaterally. The training contract starts on the agreed date, but no earlier than formation of the contract. Depending on the selected tariff, the initial term is three, six or twelve months. The specific end of the initial term is shown before the application is submitted and in the contract PDF.
The contract may be cancelled with four weeks' notice to the end of the initial term. Without timely cancellation, it then continues for an indefinite period. During this continuation, it may be cancelled at any time with one month's notice; the agreed monthly fee remains unchanged.
Cancellation is possible, for example, by email to info@shinzen-dojo.de, by post to the address above or through the website's cancellation function. A handwritten signature is not required. Receipt of the cancellation is decisive. Statutory rights to extraordinary termination for good cause remain unaffected.
5. Fees and payment
The tariff selected in the contract overview is binding. Standard: three months at 59 EUR per month, six months at 49 EUR per month or twelve months at 39 EUR per month; minimum total price including the 15 EUR joining fee: 192 EUR, 309 EUR or 483 EUR. With a confirmed discount: three months at 49 EUR per month, six months at 39 EUR per month or twelve months at 29 EUR per month; minimum total price including the same joining fee: 162 EUR, 249 EUR or 363 EUR. Only the tariff selected in the application and confirmed unchanged on acceptance applies. All amounts are final prices including any applicable VAT.
Each fee month runs from the agreed contract start date to the day before the same date in the following month; if that date does not exist, it ends on the last day of the following month. Exactly three, six or twelve full monthly fees are charged during the initial term. Starting later within a calendar month does not create an additional full calendar-month fee.
The first monthly instalment and joining fee become due only after the contract has been formed, no later than five calendar days after the contract start date. Further monthly instalments fall due on the 5th of each following calendar month. If the contract ends during its indefinite continuation, the final fee is calculated proportionately by calendar days of the relevant fee month.
Payment is by bank transfer or standing order to Anh Son Le, IBAN DE66 1001 7997 5260 3467 41, BIC HOLVDEB1. Use the contract reference and the participant's name as the payment reference. The dojo does not charge a flat reminder fee; statutory claims arising from late payment remain unaffected.
6. Additional costs and tariff changes
Karate uniforms, other equipment, gradings and association or membership passes are not included in the fee. Paid additional services are charged only after separate information about the service and price and an express order.
This contract contains no automatic price increase. Any change to the agreed tariff or fee requires a separate agreement.
7. Training times and cancellations
There are no regular children's or youth training sessions during the statutory Berlin school holidays or public holidays at the training location. These scheduled periods without training form part of the service scope shown before application; the monthly fee is spread over the contract duration. Adult training does not take place on public holidays; any other regular closure periods must be specifically stated before application.
Short-notice changes, particularly if an instructor is ill, will be communicated as early as possible. The dojo will endeavour to arrange cover or a reasonable alternative. This clause does not authorise a unilateral permanent change of the agreed location or a substantial reduction in the agreed services.
Cancellation of a session due to low attendance does not create a blanket exclusion of claims. Statutory rights where services are not provided or are impaired, including possible reimbursement, remain unaffected.
8. Safety and conduct in the dojo
Participants must treat the premises and equipment carefully, follow the instructor's safety instructions and report apparent hazards or damage. Partner exercises require consideration of experience, age and ability. Necessary protective equipment must be used in accordance with the training requirements communicated in advance.
Anyone with doubts about their medical suitability for the offered training should seek medical clarification before participating. The instructor must be informed of acute limitations affecting safe participation to the extent necessary for that purpose. No general guarantee of physical or mental health is required.
If there is a specific danger, the instructor may temporarily prohibit participation in the exercise or session concerned. Any further contractual measures are governed by statutory requirements. Statutory rules apply to damage caused; in particular, parents do not incur blanket liability for every action of their child.
9. Illness, holidays and agreed breaks
Personally choosing not to use a properly offered training opportunity, for example during a holiday, generally does not remove the obligation to pay fees. Statutory rights, particularly in the case of long-term illness and a possible good cause for termination, remain unaffected.
In special circumstances, both contracting parties may agree a break in text form. The agreement must expressly state its start, end, payment obligations and any effects on the contract term. A break does not automatically extend the contract. Only evidence necessary for this purpose will be requested; a diagnosis is not a blanket prerequisite.
10. Liability
Statutory liability rules apply. This contract contains neither a blanket exclusion for training injuries nor a general exclusion for belongings brought to training. The typical demands of the sport and the duty to participate carefully do not replace the dojo's responsibility for safe, properly guided training.
11. Data, documents and images
The dojo processes the data necessary for the application, contract and training organisation in accordance with the separate privacy information. The applicant receives an application copy after receipt and a contract copy after acceptance by email as a PDF. An identical copy is sent to info@shinzen-dojo.de for internal filing. For a child contract, the recipient is the person with parental responsibility; the child's email address is not required.
Photos and videos for the website or social media are not a prerequisite for application, contract or training. Use of identifiable recordings requires separate, voluntary and specifically described consent. Consent may be withdrawn with effect for the future. For children, the necessary authority and, depending on understanding and circumstances, the child's involvement must be considered. This version of the contractual terms does not itself grant image consent.
12. Further agreements
Individual agreements take precedence. Contract changes should be recorded in text form for documentation; this does not exclude legally effective individual agreements. If an individual provision is invalid, statutory rules apply in its place. The remainder of the contract continues unless the law provides otherwise.
Right of withdrawal
You may withdraw from this contract concluded online within 14 days without giving a reason. The period is 14 days from formation of the contract. Your statutory right of withdrawal and any statutory later start of the period where proper information has not been provided remain unaffected.
To withdraw, inform Anh Son Le, Shinzen Dojo Berlin, Neheimer Str. 2, 13507 Berlin, email info@shinzen-dojo.de, telephone 030 88691569, of your decision by an unambiguous statement, for example by letter or email. You may use the template below, but this is not compulsory. Alternatively, the website provides an electronic contract withdrawal function. Sending your statement within the period is sufficient.
Consequences of withdrawal
Following withdrawal, we will refund all payments received from you for the withdrawn contract without undue delay, no later than 14 days after receiving your withdrawal. We will use the same payment method as your payment unless another solution free of charge has been expressly agreed. We do not charge any fees for the refund.
If you expressly requested that we begin providing the contractual services during the withdrawal period and you were properly informed about withdrawal and compensation for services provided, statutory proportionate compensation may be payable for services provided up to receipt of the withdrawal. It is calculated according to the proportion of services provided relative to the agreed total scope. The joining fee will not be retained as a flat amount solely for processing the application. Starting training or attending an individual session does not automatically extinguish the right of withdrawal under this ongoing training contract.
